Prenuptial Agreements

Prenuptial agreements are intended to make it easier for a couple to part ways after they’ve been married. A Prenuptial is a way of making sure everyone knows where they stand financially in the event of a divorce. All of that works well in theory, but enforcing prenuptial agreements can be tricky without an experienced attorney like Bruce on your side.

  • Even if a prenuptial agreement seems enforceable at the time of execution, serious questions can emerge in a dissolution proceeding including, but not limited to:
  • Unconscionability – or basic unfairness – of the original agreement
  • Fraud perpetrated by the other party to your agreement, including misrepresentation of marital or personal assets
  • Ambiguities or omissions that affect the overall validity or interpretation of your prenuptial agreement

Indiana has a Statute which governs a prenuptial agreement signed after 1995. Agreements signed prior to the effective date of the Statute are governed by caselaw. Bruce has significant experience when dealing with prenuptials regardless of the date signed and can help you deal with the complex litigation which sometimes occurs in these cases..

From the most basic means of defending or contesting prenuptial agreements, to highly technical arguments impacting alimony/spousal maintenance calculations, Bruce is prepared to deal with your case.
